Samsung: If Apple Releases an LTE iPhone, We’re Ready to Sue

And the plot thickens. According to a report out of Korea Times, Samsung has confirmed that if Apple releases an LTE-enabled iPhone next month, the Korean electronics giant will slap them with a lawsuit immediately here in the States. Taken from analysis over at iRunway, Samsung currently holds 10% of all LTE patents granted so far and has waited for Apple to release an LTE iPhone for just this reason – deciding not to go after Apple’s less popular LTE-enabled iPad device. The “hit them where it hurts” approach. 

As many would expect, there is no way Apple isn’t going to release an LTE iPhone this year. It’s simply become the standard that consumers look for when purchasing a new smartphone. Plus let’s face it, if Apple doesn’t release LTE on the next iPhone, then they will have basically screwed themselves anyways.

So, will Apple release the device and then gather their legal team once more for another showdown? With unveiling of the iPhone 5 in a matter of weeks, we shall see soon enough.

    Seems like it’s just another attempt by Samsung to sue Apple for unlicensed use of a FRAND patent, I’m skeptical it will hold any water after their last attempts failed so miserably. Of course Motorola has been successful getting Apple to license their IP (in Germany at least) so there may be something there.

    what a bunch of idiots. they purchase their modems from Qualcomm who has licensed the technology and paid all other patent owners their due. Huawei has 25% of the LTE patents so you think they sue Qualcomm?

      Right on prince. They are using the MDM9615, one bitchin modem. Qualcomm holds all the responsibility for licensing. Not the purchaser of the chip. Regardless of who owns what percentage.

    for one thing, even if Sammy were to prevent the iP5 from being LTE enabled, it wouldn’t hurt sales much at all. i remember a survey from last year when a majority of iP4 owners thought that their iP”4″ equated to them having 4G. given that, i doubt they would decide not to buy just because it’s not LTE enabled. NOW, if Sammy were to file suit and seek an injunction against allowing iP5′s to even be sold, THAT could really hurt Apple. and, it sounds like Sammy has been gearing up for this for a while; so my guess is this is exactly what they will do, probably the day after Apple’s announcement.

    as to the patents, it’s not a bad move on Sammy’s part. given the recent verdict, NO ONE will believe Apple if they were to claim that Sammy was being “unreasonable” or “overreaching”. and, quite frankly, does ANYONE really believe that Apple is completely innocent when it comes to patent infringement?!?!

    this whole thing is nonsense. but, Apple is the one who threw the first punch, and has established the type of playing field. now i guess we’ll see if Apple really thought it all the way through…

      Whats gonna be interesting is if Samsung goes after BOTH the iPhone 5 and the iPad 3 (and whenever the new one is released, 4) because they BOTH will have LTE! Thats when all the iFanboys will cry and b!tch about Samsung when all Samsung is doing is giving them a taste of their own medicine!

      well, this is droid life.. so it’s but obvious they’ll dislike iphone lovers. It’s very interesting though if you analyze fandroidism. They support a non american thieving company over an American company. The interesting aspect of this is that they don’t delve as deep thinking about this. For them.. android is beloved because it is open source.. because they love the developers who crank out themes and hacks for them to experiment with.. Plus Android is ubiquitous.. a free software that most hardware manufacturers have put on their smartphones and inundated the market with..
      so there is tremendous sentiment in favor of Android..
      To me.. Google lost all of my respect when they released their flagship phone to a non-US market first… something a real American company like Apple would never do.
      That is when I seriously got disgusted by Android.. and then the bugs, lackadaisical and confusing designs were even more of an issue to me.

            You just proved my point. Apple is doing this for it’s global market.. and yet continues to provide the products FIRST to it’s American market. HOW a business conducts it’s operations.. whether employing home grown labor/materials or external, is secondary. Even in that regards.. Apple does build it’s A5 chips thru Samsung here in the US by designing it themselves first.

            Apple SPENDS money overseas for its chips; Apple SPENDS money overseas for its components; Apples SPENDS money overseas for the manufacture of its products. but when it comes time for Apple to COLLECT money, it’s allll about “America first”. it releases its phones in US first probably because the iSheep are the only ones who will stand in line to give Apple millions of dollars no matter what – e.g., iP4S: “only single core? still only 3.5″ screen? no LTE? no real innovations in the OS?! who cares – it has a voice that talks to you!!!”

            frankly, i don’t care where Apple spends its money. the reality is that we live in a global economy, and there’s really no such thing as an “American company”, no matter what product you’re talking about. it’s just silly and naive to defend a company on the basis that it’s “American”.

            The argument was about being loyal to American MARKET..NOT about how much Apple ships overseas or how much work is done in house.. Even there.. apple is pretty good standing for having hundreds of thousands of jobs in house including their customer support.. which typically most companies fan out to India or china.

            iphone 4s is dual core. Brush up on your facts before you argue.

            yes, only 3.5″ screen… who the heck says bigger is better? only you fandroids.. who have to deal with hardware manufacturers that use sub-par materials and make their phones gigantic in order to accomodate LTE and a bloated battery, RAM and processor because of how inherently inefficient and laggy Android is.
            Not to mention the laughable software designs where you are kept guessing which corner of the gigantic screen the menu button is gonna be on which you are left with no other option but to either surgically get a extra long thumb implant, or use both hands.
            There is logic and reason to everything that apple does.. Same with Samsung and other android smartphone manufacturers.. only difference between.. Apple’s logic strives to make things better or easier.. and the others’ logic is a cover-up for the screw ups.

            you’re right – i messed up on the dual core aspect.

            and you’re also right – the screens are getting bigger to cover up the OEM’s shortcomings, not because that’s what the market demands. which is why the iP5′s screen is going to stay at 3.5″. oh wait, no it’s not – it’s going to be bigger. by your logic, that means that Apple is covering up some sort of shortcoming…. [in case you didn't catch it (which you probably didn't), this paragraph is dripping in sarcasm.]

            and debating the merits of the different OS’s have no relevance to your argument. which OS is “better” is inherently subjective and individualized. all i know is that Apple’s market share has been flat going on 2 years now, while Android’s market share has skyrocketed and far surpassed that of Apple. [and before you start, i'm well aware that Apple only sells one phone, and it's the best selling single phone on the planet. but i was just responding to your statements about the OS's, and when you look at the OS's as a whole, Android is dominating market share.] personally, i think JB has come awfully close to equalling Apple OS in polish and functionality. couple that with Andy’s open platform vs. Apple’s closed platform, and it puts Andy ahead of Apple FOR ME. ymmv, and that’s fine.

            all that being said, the debate was over Apple’s “loyalty” and how that somehow places it in a superior position to Sammy (or any other company). your only response is to make the conclusory assertion that Apple IS loyal to the American market. you may believe, PERSONALLY, that releasing a phone in the US a couple weeks before anywhere else means that Apple deserves your loyalty. that’s fine, you’re entitled to your beliefs. but the objective facts are these: Apple takes a lot more money from American citizens than it gives. if Apple were truly the “American” company you believe it to be, it would take a slight cut in its multi-billion dollar profits and keep everything here. it doesn’t do that, but yet it still commands the loyalty from the iSheep. on that point, i have to say, “genius!”

            again, i don’t care how Apple operates – its doing what every other company is doing, and that’s going global. Apple deserves a ton of respect for revolutionizing the mobile phone industry. what it doesn’t deserve, however, is preferential treatment.

            oh wow!.. A private enterprise actually takes more than what it gives?? How evil!!.. How morally bankrupt of a BUSINESS to be taking in more than it spends!.. Blasphemy!! (yea.. I’m being sarcastic).

            I did not say 3.5″ screen size is the IDEAL screen size.. I said, you assertion that iphone is retrograde because of it’s smaller screen is just screwed up logic.. because it is a deliberate attempt from apple and conscious choice of it’s consumers to KEEP it that way… But the market is flooded with 4.3″+ devices.. per your own assertion that Android has the top market share.. so it’s but obvious that Apple is pressured into going a bit bigger.. but even then notice that it is only 4″.. NOT even 4.3″. Point being.. It is a tightly controlled and logical decision to keep the form factor. But Fandroids are into gimmicks.. 4.5″+ screens… quad core processors… multi Gig RAM… It works well, because fandroids salivate over these gimmick factors while nonchalantly ignoring the inherent flaws with the OS.

            The only reason Android has a larger market share is because the market is inundated with Android.. Period!.. It’s like how you see Kim Kardashian everywhere.. not because she is classy or has any substance.. it’s because she is ubiquitous!… and Samsung is the Kardashian of the mobile world.

            It is not subjective, but quite objective when you break down efficient use of resources and general performance.. I know this, because I’ve had Android for over 2 years.. I’ve smali’d baksmali’d themed, programmed, ROM’ed the heck out of android. It is a hackers’ delight.. but if fails miserably at the smallest of things. Yes, Jelly Bean is by far the most ambitious attempt by Google.. but even Jelly Bean has it’s bugs. Take copy and paste for example.. when you copy multiple links and paste them.. they are not longer pasted one link per line!.. It’s incredible how the minor details are over looked. Second was with the menu button.. Absolutely no consistency or logic behind it’s placement in an app. Could be any corner of the screen.. OR in a capacitive button in other phones!.. Ridiculous!

            “conscious choice of consumers”?!?! since when have consumers EVER had a choice in what Apple does. Apple does what it does IN SPITE of consumer choices – i.e., no flash, the i4 antenna (“don’t hold it that way”), etc.

            and again, you regress into a debate involving personal preferences for OS. i was trying to use logic, and you insist on arguing with emotion – brightly highlights the absence of logic you have.

Steve jobs did win from his grave about flash didn’t he? :)

            ‘ with that statement, you are saying that the screen size was a conscious choice of consumers. but, they didn’t have any choice in the size of the screen. NOW, you say that because it sold 4 million units at launch, that somehow validates the choice of screen size. well, the GS3 sold over 9 million units in the first two weeks – by YOUR “logic”, this validates the “choice” of a bigger screen. [as an aside, the "conscious choice" of consumers could amount to innumerable things wholly unrelated to the actual functioning of the device: "it's new! it's shiny! i can get a cute case/protector for it! it's cool! it's a status symbol! i like Apple's ads. my work only pays for Apple phones. it's simple to use. etc. etc. etc.]

            as for your “bulleted points”, so far, all you’ve said is: “the laughable software designs where you are kept guessing which corner of the gigantic screen the menu button is gonna be on”. in the immortal words of Carl from Caddyshack, “check me if i’m wrong Sandy” but how is placement of a menu button anything but a personal preference?!?! YOU may find it illogical and silly, but for most of us higher functioning primates, it’s not that big of a deal.

            as for being “laggy”, that’s perception [everyone knows that benchmarks are inherently unreliable]. besides, i often goof around with my friends by doing the same tasks at the same time, and my GNex beats their iP4′s far and away most of the time. [i'm not saying Andy is better, just that it's pretty close to equal.]

            i agree with you, the Apple OS is extremely polished and fluid. but, as you acknowledge, JB is very close. but you fail to account for the closed vs. open nature of the OS’s. Apple is smooth and polished because it is closed and controlled in every respect. Andy is more open. You reach your “objective conclusion” of the superiority of Apple OS based on YOUR personal preference for the fluidity. however, when you look at the OS as a whole, MY personal opinion is that Andy is a “better” OS because it is so open and allows me to do so much more than the Apple OS does.

            to be clear, i’m not trying to convince you that Andy is objectively better than Apple. i’m merely advocating that the “better” OS depends on personal preference and opinion and uses. and, i’m just trying to point out that your argument as to the “better” OS hinges on your personal preferences, and not logic or objective facts. the ONLY objective facts are these: Apple OS is fast and fluid, but is closed and controlled; Andy is wide open, but not as fluid or integrated. now, reaching a conclusion as to which one is “better” based only on these objective facts cannot be done – it is only when personal preference are injected can one reach a conclusion as to what is best for them.

            what you call “inadequacies” [and claim to be objective inadequacies] are all part of of an open source OS. if i used your “logic” i would vehemently denounce the inferiority of Apple OS because it is closed, and there’s no differentiation. but because i am, by nature, constrained by actual logic, all i’m saying is that, because of my personal preferences, Andy better suits my needs and uses – and apparently that of millions upon millions more people.

            Typical knee jerk defensive reaction of a fandroid when confronted with the facts. Fluidity of an OS.. it’s efficiency and performance are NOT a matter of “personal choice”..It’s as pathetic as an obviously unattractive person saying “beauty is in the eyes of the beholder.. I am very beautiful”.. Well no.. sorry honey.. the terms and parameters the define beauty are pretty well established.. and though it has a fairly wide margin of accommodation.. if you clearly fall outside of it.. you are NOT beautiful… .. Not that I consider beauty a plus point or a negative if there is lack of it thereof.. but it were a beauty contest.. then the unattractive will clearly stand to lose.
            Similarly, but all design Standards.. Android is confusing, poorly thought thru and simply not as consistent as ios. Sure there are millions of people who are extremely comfortable with it. Heck I had a hard time getting used to ios for the first few days when coming from android. But only when you experience “heaven” after coming from “earth” (to borrow the analogy from Samsung’s CEO).. do you really understand how truly inferior android is. Right up to the last few versions of the Market app (when it used to be called Market). .. the grey search box had black fonts when typing.. That is NOT a subjective screw-up in design.. It is objective. So yea.. feel free to hide behind your “subjectivism” and “personal preference”.. It matters to zilch because as current market trend is going.. more android users are increasingly frustrated and wanting to switch than ios users. Sure there will still be millions of activations every day (which is what they count to figure market share).. but like I said.. that is ONLY because the ubiquitous nature of Android and aggressive marketing by carrier sales personnel who wanna highlight the “Droids” and “Galaxys”.
            When I said the 3.5″ is a consumer choice.. I obviously mean that consumers are very comfortable with the choice.. because it is both logical and comfortable. Consumers are aligned with Apple on this and in fact several iphone blogs are filled with how people would hate for the screen size to get any bigger.
            I don’t blame you for loving android because of it’s open source nature.. but logically it can shown that in a business model.. it is doomed to be corrupted and confusing beyond any limits. I won’t even venture into the problems that have backfired on google with fragmentation. If you are worth your salt.. you already know it. The vast majority of Android handsets are junk.. both in terms of current hardware and because of guaranteed “pariah” status to be inferred on them in the near future with no updates or fixes. The vast majority of them are on Gingerbread for chrissake.. while Google has already deployed Jelly Bean… So what now? all those millions of users are supposed to get a nexus device to partake the experience and be part of the single digit percentage of Jelly Bean Uers, Or.. be among the 10 percent of android users who enjoy the already outdated Ice Cream Sandwich???

            I hear these lame excuse of a reason from fandroids somehow consoling themselves for being stuck with an outdated hardware with the newest android OS.. or with an up to date hardware but with a ridiculous android skin. XDA is filled with such complaints and valiant attempts to superimpose pure google on good hardware or people already frustrated with pure google on bad hardware (low speaker volume, bad radio reception on galaxy nexus).

            Yea.. subjective my ass.

            …and i forgot to point out Apple’s lag in innovation – last to the table in dual core, last to the table in LTE, last to the table in navigation, etc. Apple can integrate like nobody’s business, but innovate – meh, not so much anymore…

            The apple iphone 4s has a linkpack score of 178 OUT OF THE BOX!!.. yea show me ANY android device that comes close to that!!..
            It is all about the software stupid! Your large pentile screens and quad core processors are worth crap if I can’t make a single phone call without the phone freezing up on me 5 out of 10 times!

            Yea, that is googles goal, to make money. It may sound crazy but it is true. Frankly the majority of companies send our jobs overseas anyway so I don’t see any company as loyal. And personally, I am loyal to my friends and family. This government is just like any other corrupt and will not think twice about killing innocent people for money. Because of this no country or government deserves my loyalty.

        I don’t have a problem with Android, I am fine with it being there and every now and then I will buy one to test it out such as the Galaxy Nexus and Galaxy S3 but as my daily iPhone it’s the iPhone 4S for the apps and the camera. The OS is really nice to use.

    Great for Sammy, but after this, some questions came to my head. Sammy owns 10% of LTE patents. Then who owns the rest? Maybe Google, maybe HTC, Motorola or Huawei… then will they sue apple too? That could be great!!

    look, as much as I love Sammy going back at Apple, you have to imagine that Apple is prepared for an import ban. They probably have been getting units from the China Foxxcon factories for a few weeks now and have been getting them to the various stores so that on launch day they can sell out before the injunction Sammy will file will go into effect.

    Long-term for Apple though, this could be a problem. However, Apple will accuse Sammy for demanding licensing fees that are too high and simply won’t pay for them. Apple has been doing that around the world and most notably has been doing that with Moto. The court system and the FCC have to be prepared for this legal filing if this is making this kind of news already.

    I see one of two things happening. The injunction gets denied the day it is filed OR The injunction gets granted too late for it to have the effect it should have.

          It’s a marketing gimmick, iPhone’s fake 4G can only do about 5mb up and around 2mb down in real world situations (I don’t want to hear,”AT&T (or whatever carrier) guarantees ____ because its BS) while Verizon’s 4G LTE offers around 20-30mb/s down and around 10-15 up and it offers some of the lowest ping times around!

      That’s because if you have a 4S on AT&T, it does say 4G, even though its not.

      Unfortunately, marketing can get away with 4G != LTE. T-Mo and AT&T both get away with HSPA+ being “4G”… until recently, VZW was the only one who could legitimately say they had 4G/LTE..

      How crazy would that have been if T-Mobile and AT&T heralded 3.5G against Verizon’s 4G? VZW marketing would have eaten them alive.

    Don’t you think that Apple would just pay the licensing fee if it was really worried?? They could do the same thing that Samsung did. They could always not pay the licensing and see how a court rules. I’m sure the courts will still keep ruling in favor of an American company. I would!!

        No, they most definitely would not. First of all, carriers taking sides is just bad business. They would lose the trust and respsect of the rest of the industry. Apple might be the leader in the US but Samsung is the mobile leader worldwide and is rapidly making headway in the US. Second, carriers know that even if Apple loses a case, they wil find a way to settle or work around it. There’s no way on earth Apple would not release a new iPhone; LTE or not. Therefore it would be absolute idiocy for any carrier to step in for any OEM. Just won’t happen.

      You know how carriers make money, right? They lose money on phones. They keep on collecting monthly fees whether a phone comes out or not. So long as the iPhone doesn’t come out on only one carrier so that people switch to it (which they can’t anyway, thanks to contracts), they don’t lose one penny if Samsung gets the iPhone blocked, they just keep on collecting.

        Not sure if they hate them, but you do hear them complain about the device. AT&T was just in the news about their treatment of Facetime. At one point, it was rumered that VZW had to switch to tiered data because iPhone users were taking up so much bandwith. T-Mobile refuses to carry them. So, I think you have a good point there.

      Carriers would be more willing to boot no one. Carriers also know that injunctions can be worked around and patent cases can take months if not years and they’d make money regardless. Carriers are probably making use of those same patents right now. They know this is not a fight they want to jump into; VZW or anyone esle for that matter. Samsung, by the way, is a global juggernaut. They are the #1 tech manufacturer in the world. So big that Apple has rode their back for years by incorporating their parts. No one’s kicking them off of anything.

    Let’s be real, here. Apple’s legal team is legit. Do you really think a court will force Apple to never use LTE? (Hell, they already have it on their iPads).         No LTE is not a function required to use the phone, so it is not FRAND. FRAND covers tech that is essential for the devices to function, and every LTE device has more than one radio in it because LTE coverage is not universal.

          I am not sure what case you are referring to, however, if it is the recent one that just passed, I will have to disagree with you. I am a huge android fan and own a galaxy GS3 but Samsung did infringe on Apple’s patents, and that is why they lost the case. I think apple should have never been able to patent many things due to prior art but that is irrelevant now. If apple infringes on Samsung’s patents they will get sued unless they pay Samsung a licensing fee.

            Yes, I do think that Apple was insane with all of things that they patent. It gets to the point where Apple can’t or refuses to move fast enough and thus don’t want to play fair so they just sue everyone and try to slow them down.

            In SAMS case, yes they will sue but it would better for them to just make money on all the iPhone sales by signing a licensing fee.

It isn’t Apple’s fault it is the patent system’s fault. If I could legally patent crazy things and make 1 billion dollars I would do it also. They are companies with one goal and that is to make money. All I am saying is if apple uses Samsung patents with out their permission Samsung should sue.         I have not suffered anything, but other customers will suffer due to less choice available if devices get banned. Samsung might also have think twice before lowering current prices in order to help make the money they lost. So, yeah, the customer loses, and that is why I said I was hoping for apple to include LTE, so customers don’t suffer.

            Actually, unknown to most people, Tim Cook was in charge long before Jobs died, it just wasn’t something that was public. Anyone who says “Jobs died with the innovation” is a liar. Also, what do you even want anymore? It will probably have a larger screen, LTE, retina display, thinner design, new port, etc. Also, NO ONE should even mention NFC anymore at this time, because no where but big cities have any stores that even support NFC.         You do know that even though the current gen iPhone is the single best selling individual phone, that Apple does not control the majority of the smartphone market, right? In fact, their market share has been for the most part stagnant for the past three years, only growing at all because they are taking customers from RIM and Microsoft. Android phones are by far the fastest growing market segment.

        So, while what you are saying is true, the fact is that the iPhone is not attracting many new customers; the sales numbers indicate that the people buying them are usually people upgrading from an older model iPhone. Samsung, on the other hand, has seen tremendous growth quarter after quarter and shows no sign of slowing down.

        With the release of a new phone that is not simply a placeholder like the 4S was, Apple will certainly gain some momentum next quarter, but it is very questionable whether they will be able to remain the market leader over the next year.

    soooo not true. That’s what they said last year.. and the iphone broke all records! For CDMA (read Verizon users.. coz Sprint LTE deployment sucks).. I can see how lack of LTE is a bit frustrating.. but it is not as bad. ATT users already enjoy 3-6 Mbps.. which is plenty.

    I am a big fan of LTE.. but LTE really is not necessary.

Considering Apple has never used LTE in a phone and when they put it in a tablet it wasn’t the first, Apple won’t be able to claim they have prior artwork, thus enabling their legal team defenseless. Unless of course they want to pay Samsung a huge amount of money per device sold! :)

            Well considering pinch to zoom is only one feature I would say its safe to assume that one feature can corrupt an entire device. Also, most users now own 4G LTE devices so for Apple to get those users wanting to switch they will at least have to provide equal hardware. After using 4G LTE, there is simply no going back! Personally, if a phone doesn’t have LTE, I won’t even consider it!

I would rather my phone last all day easy and i get decent speed then get lightning speed and I can use my Nexus for 4 hours or my GS3 for 6 at best

            I get a solid 16 hours out of my Droid Razr on 4G LTE and it is considered the worst phone as far as battery is concerned. It’s not that bad unless you are sitting there streaming movies, music, etc all day long. Plus, I would rather carry an extra charger (or just leave one in the car) and use it when I need it and get faster internet than pulling my hair out over the slow speeds of 3G. Not to mention trying to tether to my computer. I’m able to have 8 devices connected and they’re all able to load webpages, download files at far above normal speeds. Heck, I tethered 8 devices at my school the other day (the WiFi went down) and my phone was running each device faster than the school’s wifi.
            P.S. I typically get over 30mb/s on FoxFi tether on 4G LTE!

            Same, I get about 30-35 download on my S3 but for me the battery was bad. I am considered a very heavy user when it comes to texting and apps and downloading apps and such so for me it did use a lot more than you probably but its good that you get the battery life that you do and I don’t really like carrying all these extra things like batteryies or a case cause i like how the phone is without all that stuff

            I just have an extra car charger in my car and use it when driving. I use to carry extra batteries for my Thunderbolt (that was the single worst device ever made) but that gets tiring and annoying! But the Razr is my favorite device so far. It’s amazing how thin it is and my only regret is not waiting to get the Maxx.
            P.S. I use my phone heavily, I just have a smart actions rule that turns 4G off when the phone idles with the display off. I believe for other devices there is an app called Juice Defender which will do the same thing.

            On mine if I turn it off it will stay at the same battery percentage for over three hours straight! Love it because it gets rid of the notifications while in class and saves battery. But they need to make a juice pack like for the Droid Razr because they could make a case that basically turns the Razr into a Razr Maxx just by using the space between the camera hump and the kevlar back.

            It seems like you really aren’t informed on the legal proceedings that took place at all. It wasn’t pinch-to-zoom specifically, it was that the phones were willfully copied and matched all points on a patent that related to all manner of interactions with a touch-screen device. 1 finger uni-directional scrolling, zooming in and out, scrolling instead of panning, etc. If you only copy 1 point in a patent that registers 10, then you aren’t infringing. Even if you copy 9/10 items in a patent you aren’t infringing. Samsung could have easily included a 2 finger scroll, or instead of locking the scroll direction when moving one finger on the screen allowed it to pan side-to-side as well. They chose to completely infringe and admitted to it through conversations between executives.

The methods of moving the media and web browser on a screen, the number of fingers used, the lock-scroll method, pinch-to-zoom, etc. Prior artwork had nothing to do with the majority of litigation. Prior artwork only applies to design patents.

            the one thing that all of you are missing are all the other patents out there for different types of LTE coverage, they do NOT hold 100% of the patents for LTE, just a little over 10%, so what if they are using a different technology for LTE and have a licence from a company like Nokia or Erickson who also hold LTE patents… just some food for thought

            I used to make idiotic statement like this too until I actually started using my wife’s iPhone and eventually got my own. He reason they seem like “isheep” is that apple tightly integrates eat device to work seemlessly with each other without the need for 3rd party apps. If I send a message on my phone it shows up on my MacBook pro and my iPad. Screenshots or pictures i take do the same. If I destroy my phone and have to buy a new one, iTunes automatically backs up everything down to the high scores I have on temple run without the need for Titanium Backup. Every time I think about switching back, there’s way too many conveniences that I take for granted that reel me back in. I hate to say the cliche but they just work better on iPhone.

Apple represents 1 ecosystem while Android and Windows each represent their respected 1 ecosystem. Apple has made the fatal decision to release 1 device per whatever their cycle is. That is the reason people don’t buy them anymore. They are starting to finally realize that if you buy an iPhone it’s already 6-12 months old in terms of specs and features. You’ll never have the latest and greatest if you buy an Apple product because of this. Is it an unfair comparison? No because Apple made that choice and thought it would be competitive. It isn’t.

You don’t have to like their product at all but you’re way off if you think tens of millions of people won’t buy the next model when it’s released this Fall.

            Annual iPhone sales are growing significantly due to two factors: sustained customer demand and overall market growth (as many phone owners switch from “dumb” phones to smart phones, especially internationally). Android is growing like crazy too as there’s a ton of demand for both platforms.

            But the market share argument of iOS vs Android is not a meaningful comparison. Apple makes one top of the line model that sells like crazy and makes strong profit margins. Dozens of Android OEMs make and sell a range of devices from the entry level to top of the line. Most make little or no profit on their devices. Many individually have little recognition in the marketplace from a customer loyalty standpoint.

            And back to the Apple says trends for a moment. Yes, these are clearly more volatile than prior years, when there were fewer high end competitors in the iPhone’s class to pique the interest of customers. Yes, customers are clearly slowing down purchases of the iPhone in the final 4-5 months of its 12 month product cycle compared to prior years. But name me a single Android phone whose sales don’t significantly drop off 6 months post release. Can you think of a single Android phone that approaches the iPhone’s sales volumes 9-10 months into its product life cycle? The only one that is potentially close is the Galaxy S series.

            Finally, ask yourself this question. If the iPhone is really not selling anymore, if “nobody” wants to buy it…….then why is this site and similar pro-Android forums filled with complaints about why so many “sheep” and “iMasses” are blindly buying new Apple products without considering the Android alternatives? I really doubt there’d be that much to complain about if the iPhone was no longer selling as you claim, right?

            Again… it is a completely meaningful, valid and fair comparison and this is what a lot of people fail to grasp. People like yourself look at Apple as though they are being unfairly victimized because they only release a single product. Wrong. That is Apple’s market strategy and it’s a failed one. We are comparing market share of an ecosystem not a singular device. Apple will continue down this path and eventually once again go back to being just a niche company. They are losing drastic market share at every device level to Windows and Android and without a major market shift this trend will only grow.

            If you’re going to compare the market share on ecosystems, wouldn’t the relevant comparison have to extend beyond just smart phone sales? The data you’re citing pertains to phone sales only. On the smart phone side, Apple’s market share has been relatively flat year over year while Android’s has grown considerably. You cite the most recent quarter where Apple declined a bit, but failed to acknowledge the reason – Apple sales are now dipping once it’s current gen product hits the last 1-2 quarters of its product life cycle. But the minute they release a new model, market share will spike again to correspond to the jump in sales. In a given year, their share on smart phones will probably fluctuate between 15 and 25%, give or take. And let’s say that during the same year Android will be in the 60-65% range or so. That still is not an accurate depiction of ecosystem market share, however. If you’re going to do a true measure of that, you’d have include several other device markets, most notably tablets, where Apple currently enjoys over 60% market share. To a lesser extent, you’d also want to include other devices running iOS such as the iPod Touch and Apple TV, plus Mac computers as well – their software has incorporated most of the features of iOS and is all part of the same ecosystem. When you layer all of that in against the Android equivalents, do you really believe that Apple’s ecosystem is niche and is small potatoes compared to Android?

            Apple’s strategy isn’t to take share with just phones……it’s to build up an entire ecosystem across devices that keeps their customers tied into the recurring cash flow streams of iTunes and the App Market. The iPad is a huge part of this just like the iPhone. Regarding future trends in market share, the thought is that Windows will have a higher market share percentage in smart phones than Apple by 2016. If they follow the Android model of multiple OEMs across all carriers, then I agree. But most of that share gain will likely come at Android’s expense, not Apple’s. There is no way Android stays at 65% share in phones if this becomes a 3 horse race. The iPhone and now the Galaxy S series have dedicated customer bases who will continue to buy new models. Everyone else? Not so much. To be fair, the iPad won’t be able to keep 60% share either for similar reasons.

            Either way though, the Apple ecosystem is not going anywhere or fading away as you’ve erroneously depicted.

            My original point related to why Apple’s smaller share in the smart phone market didn’t matter. Take a look at this recent article in Forbes that has a similar view. We can argue whether Android is better quality than iOS, but there is no logic or validity in stating that nobody buys iPhones anymore or that its ecosystem is niche/minor.

            Thanks for giving me the heads up on Apple’s future product pipeline by the way…..that was very insightful, detailed and unbiased. I’ve got a similarly brilliant analysis for Android that I just pulled out of my ass: they’ll release a bunch of phones next year. Most of them won’t interest anyone or make profits for any of the OEMs besides Samsung.

            One final thought on market share from a smart phone perspective only (I’ve already covered the issue of ecosystem market share in a separate post). The whole point of being in business is to make money. As smart phones go, no manufacturer or software provider makes more money than Apple through the iPhone. Android the software has much larger share, but it comes at a cost – most of the OEMs aren’t making money off of these phones. If Apple wanted to take more share, they could do so at any time by lowering prices, licensing out their software to other OEMs or making a broader selection of low cost devices. All of these would negatively impact their profit margins, so economically they have decided that 20% market share with 40-43% gross margins is more valuable to them than 40-50% share at a much lower margin percentage.

            None of that reflects a lack of demand or consumer interest for their products. If anything, they are artificially building up demand every year compared to Android by only releasing one model. And when it comes out, it sells like crazy. I don’t know what evidence you can point to that indicates this trend won’t continue into the future.

Considering this phone will have a different screen size, LTE and one or two other changes, I’m thinking it will be marketed as a significant improvement and will drive tons of sales like prior models. Note that I’m not giving an opinion on whether the iPhone SHOULD have such high sales – I’ll wait to see it for myself before figuring out if I’ll buy it. But my opinion is irrelevant on this one as is yours – it will sell like crazy to the frustration of Techies who wait to see beefier specs and more radical changes to Apple’s legacy form factor. To not acknowledge this as the most likely outcome is either an indication of ignorance or wishful thinking.

            I stopped reading your comment when you said that Apple has an advantage in overall market growth… Apple’s market share is actually in decline, and the more lawsuits it throws around, the less share it will have because people don’t like Apple’s petty move at domination by litigation. You may say “But look, Samsung is doing it too!” People look at Samsung’s move as retaliatory, not assertive. That argument would be worthless to say Samsung does it too. Either way, if you can get your hands on a iPhone 5, you’d better if you want to- Samsung and Google/Motorola will definitely have something to say about it in the near future, considering Apple likes suing over touch screen interactions, icons and black rounded rectangles.

            Their phone share is flat year over year rather than declining. The overall smart phone market is growing and Apple is growing at close to the market rate which is why their share is staying flat as a percentage of the overall market. Android is clearly growing faster than the market and is taking share from RIM, Nokia and others in the process. Your point about Apple’s share falling recently is because the 4S is so old – when the new model comes out and their share spikes up for a quarter or two, what will your position be then? You can’t look at share from just one quarter to the next without factoring in the timing of product releases. To me, that’s why the year over year trends are more relevant.

            Based on those trends, Apple’s share is relatively flat and as I mentioned in an earlier post, it’s not critical for them to be at 40 or 50 percent to share because of the business model they’re running. As long as they maintain a decent piece of the market for smart phones, their presence in the tablet and other device markets gives their ecosystem plenty of footing among millions of customers. This is crucial for them because within the ecosystem they’ll make recurring purchases from itunes and the App market.

            Not all LTE patents are standard essential (FRAND). Samsung has already found violations of its LTE patents in the LTE version of the iPad, and these are hardware patents. Apple just pissed off the wrong company. They are in some real trouble as soon as they release a LTE iPhone.

The iPhone WAS the top selling phone, period, for quite some time, before Android picked up speed. Now that they control the market share, I have no doubt that individual models, by more than likely Moto or Samsung, will beat it in sales, LTE or not. If the GSIII wins this quarter, then that’s 2 in a row Apple loses then. Even when the 5 comes out, after the holiday season ends, Android will likely pick up where they left off, and dominate. Why? Because Android phones don’t require them to be serviced by Google if something goes wrong. Because the Google ecosystem isn’t locked down. The biggest reason though? Choice in devices. Being in the wireless industry I can tell you that customers like choice, not to mention the customization options the OS allows, and the ability to take the device back to their carrier to have all their issues taken care of, instead of having to call Apple (who charge you for tech calls after 3 are made), or drive to the nearest Apple store to have something fixed.             Even though Android does have a lot of phones why can’t ONE measly phone be made that can really be considered an “iPhone Killer”. Well it’s because the Android name is saturated.

            As for the OS, that’s a different story. If you look at stability and user friendliness the iPhone is a lot better. I have had a handful of Android devices and a few iPhones and some other iOS devices as well and can say this first hand. I should say something good about Android and I will. Tethering easily without JB. Customizing can be done which is nice. A lot of other things as well but I have some other people to respond to quickly.

            Ok this is getting annoying, I officially hate DisQus! I’m probably gonna be summing up 2 of your posts into this one bc I’m so lost as to where what convo is where lol but anyway. How can you say apps are garbage, personally I used to use an iPod Touch for years before I bought my first Android device and I found the exact opposite! Apple just can’t touch nvidea and their top notch graphics! I have never even downloaded a bad app so to speak (unless you count facebook lol there is no hope for them). I love games like Shadowgun, Dead Trigger, Riptide, and even some of the FiFa games (those are my top games right now). Not to mention I have had an Android for almost 3 years now and I have never paid for a worthless app that should be free. I have only bought major games such as Riptide, ShadowGun and GTA 3 because they were high end games that were fairly cheap for what they are.

            It was actually a 4th generation one and both my parents own a 4S and from my experience with the 4S they’re ripoffs. Siri is a joke, taking forever to reply even on our ultra fast internet and on Verizon’s 3G it is unusable bc its so slow. Not to mention she always translates the wrong thing. I will say call Maddox (my dad’s coworker) and she will come back with some random contact that isn’t even similar. Second, lack of 4G, I believe me and u are having a convo on this in another section. Third, they’re so slow. From downloading, loading webpages, launching games, multitasking(isn’t that a joke) and answering calls. They just lag and are slow in general.

            Not to mention, I like free things so the Play store is like heaven for me! lol But 4G makes even browsing the web faster because of the lower ping times. Makes for a much more responsive experience and faster overall speed.

            If the iPhone makes you happy, by all means go for it. I just hate those uninformed people who think they’re all cool when they don’t even know how to operate their own device. IMO, I think both Android and iOS are about equal its just Android is open resulting in really cool mods and ROMS. That why I love Android, the options of things to do with it is endless and most of them are easy to accomplish.
            I’m actually excited for the new Google Play gift cards and I hope to start using those as soon as possible (I don’t trust major companies with my credit cards, just look at Apple getting hacked with just a phone call) and I would much rather just run to the store and buy a Gift card. But I see problems come christmas time, everyone is gonna get mad if you buy them an iTunes card but they use Google play and vice versa.

            Yeah, I laugh when people buy and iPhone and can’t even understand how to use that. I use iPhone because the modding and ROMs don’t appeal to me. I don’t wanna put too much time into that and losing data and such like text messages and IDK it just doesn’t really appeal to me but I see the merit and have done my share of modding and hacking Android and iPhone. Fun, but in the end I revert to stock on both.

            Yeah, getting a card for me would be a good gift but I can see how that would be lame for some. And yeah, I do trust Apple with the card even though maybe I should not I do but I don’t trust putting mine into my android cause of the apps and what they can do.

            Most Android apps are good, I just read the review and make sure they’ve got good reviews. After all, Google is a multi-Billion dollar company so I’m sure they aren’t going to let a few bad apps spoil everything.
            I to run stock but on top of the stock i have a few things added. Such as FoxFi, additional Widgets and a whole slew of customization apps. I find stock to be the least time consuming and stable. Plus with apps like FoxFi I have no reason to root and ROM because developers ahve found workarounds. Thats something iPhone will never have, hackability without Jailbreak or extreme effort.
            Also, iPhones are kinda idiot proof, I seriously don’t see how people don’t understand it! It’s UI is simple and thats what Apple is based off of, A simple easy to use interface. But for some reason people still lack the basic skills to understand an iPhone!

            Ahh I was waiting for that one. The iphone killer. I can name 5 phones right now that are iphone killers but it won’t matter to you. I could easily site the Note 2 which kills the iphone, but lets just stick with the SIII. Especially after it is updated to jellybean. Google Now just kills Siri, you cannot deny that, but you will. You see Android users buy phones based upon the phones merits. Apple users buy the iphone based on market hype. There is no getting through to you because you are close minded just like the phone you use. Someone mentions LTE, and suddenly you don’t need LTE and 3G is better. Thats what apple is counting on. In fact if they never offered a 4G phone, wait lets say 3G, actually I will go one step even further. If apple released a 1X iphone where you couldn’t even get on the internet, you would still say the phone is better. 10 days talk time, I don’t need to get on the internet, that’s what my ipad is for, phones are made for talking, blah blah blah. So spare me with the whole iphone killer debate okay? What you need to say is: no one has invented the apple hype/brainwash killer yet. The iphone, and ipad, have already been killed. And you don’t even want me to get started on Windows 8 tablets. Ipad killed by Microsoft. Wait for it.

Also, one of the main things I like about iOS. Until the hardware can’t support it, my phone gets the updates as they’re released. When is the VZW GNex getting JB?

            I don’t know if you’ll see this, but hopefully you will, and hopefully others with iBlinders on see it as well…
            There’ll never be a single, Android-powered handset crowned as the “iPhone Killer” simply because there isn’t a sole manufacturer out there producing the only handset running the OS. Android is all about choice and variety.
            You want a device with an immense screen? Here’s a Galaxy Note. You want a device with a QWERTY keyboard? Here’s a Droid Pro. Want a device with a ridiculous MP count on the camera? Here’s a Xperia Ion. Don’t need the latest and greatest specs that’ll cost you $300 on a 2yr contract? Here’s a Galaxy Stellar.
            Getting the point?
            The variety and diversity that Android fosters is what has killed the iPhone. Android as a whole has outrun he iPhone in marketshare, and I don’t expect it to be overtaken.
            The success of iPhone sales numbers are misleading for no other fact than it is the only handset that the iOS platform is available on. It’d be like if Ford only made one car and one car only. The sales figures of that car would look phenomenal compared to the countless other vehicles available in the market, but only because it’s the only car they made.
            Saying that the “Android name is saturated” is like saying there are too many car options available.

            The problem is you are thinking of the iPhone as just 1 phone. No there was a iPhone, then a iphone 3G, then 3gS, then 4, then 4S, now 5. So yea that is 5 phone and now soon to be 6. I will give credit where credit is due, iPhoen has paved a way for the smartphoen generation, but as i’ve read somoene say – They’ve plateau’d. And until they do some UI redesign instead of add small features i think you might see more of the same. more and more carrier are pushing high end Android phones. And i am sure there will be lines of people waiting for the next iPhone, but really….why..

            If you did a breakdown of iPhone 4s sales vs Android sales since the 4S dropped, im sure Android crushes it.

            Actually from person tests with my S3 and IPHONE my IPHONE is by far more durable. I have dropped it several times with no damage and no case. However, one drop with my S3 from the sofa about a foot down to the floor hitting carpet chipped the top right side. I would say that is what you should expect when your phone is made with garbage plastic. OWNED

            Everyone I know that has a iPhone has either cracked it within a few weeks of ownership, or they have it coated in four coats of rubber and plastic armor to keep it from breaking. I never question who has an iPhone around me.. All I have to do is look around and take note of the thickest, ugliest, wildest colored phones. They are all iPhones covered ten times to make sure they don’t get broken.

This makes your point sound childish. iOS and the iPhone is incredibly far from dead. They have a market share of over 25%. That’s incredible for a single phone manufacturer. They’re competing against phones from several different companies that run the same operating system.

            It is a pity that apple are so slow at innovating, they created the market but others that have faster innovation are now owning it. What apple needs to do is release a phone that is super duper thin and light and maybe even has a see through screen. If not they will fail in the market which is a pity, but should encourage them to do that extra mile in releasing more innovative devices they have in there labs.

            I don’t particularly like apple but they were the ones pushing innovation and that can only be good for everyone.

            They didn’t create it so to speak, more of just made it popular. Heck, I don’t know anyone that actually liked the first iPhone and even the 3G for that matter. I agree with you on the innovation tho, they were on of the first companies to make giant strides in smart phone production but quite frankly they’ve gotten lazy lately. My Droid Razr was released the same month as the iPhone 4s and my Razr is half as thick as the iPhone at its thickest point and less than a third as thick as the iPhone at it’s thinnest point. Not to mention it still packs a bigger battery (per mHa), faster processor, more memory, same camera, better front facing camera, far superior radios for connectivity (nothing competes with Motorola’s connectivity :)), AMOLED display, 4G LTE, and nothing comes close to Motorola’s web dock and their docking station accessories. Apple is really behind here and they need to catch up in order to prevent their customers from jumping ship to Android! (All my iPhone friends gawk at the Razr and it’s web dock!)

            Yes I did, I am sure that I use my phone more than them. I had the S3 and IPHONE 4S at the same time, don’t tell me what I did and didn’t have and what battery I got. It was bad for me so just accept that. And yes I know that other people got good battery life I was saying from PERSONAL testing what I got. Had the Nexus too and that had bad battery.

    I could be wrong on this, but I think because they basically said they’re sitting in wait, the case would get thrown out. Allowing an iPad to be sold but waiting for an iPhone would show that they aren’t taking any losses by Apple using their 4G patents.
