Chinese Makers of Goophone Intend to Sue Apple Upon Release of iPhone 5

In a piece of news that is just too wild to believe, the makers of the new Goophone I5, an Android powered device that is in the shape of the upcoming iPhone 5, intends to sue Apple for patent infringement upon release of the iPhone 5 in China. Designed from leaked specs on the iPhone 5, the Goophone has already been patented in China and the company will do all it can to make sure Apple doesn’t steal any of their hard work. You’re kidding, right?  

Anyone remember GooApple 3G? It was the original Android powered iPhone device that was actually pretty awesome. Either way, if this company actually intends to sue Apple, that case probably won’t last long. Apple’s lawyers would most likely have a field day with these copycats.

    The Author foolishly believes that the Chinese judicial system will for some reason believe Apple’s claim of previous art against a company that has already patented designs in China. The Chinese are protective of their own if anything and prior art is not an argument when it comes to Chinese patent law. Especially when attempted against a Chinese Tech company. Just like all the other companies that put profit before people and moved their manufacturing to China and India They ave given up a certain level of security and justice for the privilege of using foreign slave labor to build their products. China holds some 10-12 billion of the US Debt. You should expect our Chinese overloads to start demanding more for buying US Federal debt load.

    What worries me is I kinda don’t see this stopping with Apple, what if/when they start threatening Android OEMs?
    I’m no fan of Apple but I hope they nail these chumps to the wall…

    I’ll be interested in how they handle it. They allow companies to blatantly rip off the designs and tech from cars, electronics, etc and say “we don’t see how they look or act the same” when even a blind person could tell its copied.

    Also why does it have the Honeycomb bee on the back and top corner of the pics? Is that their mascot or something?

    People comparing this to the US are forgetting that this is China and their laws are VERY different from ours. They look out for Chinese companies big time, and while this may be ridiculous and would not stand a chance in the US, there is a very good chance this will se a court in China and Goophone may even win.

      In most cases, I’d agree with you. However, Apple employes a lot of Chinese labor, and they aren’t willing to let go of Apple products or money anytime soon. At best, the Chinese political machine will start up and find a way that allows them to keep Apple, even if it means strong-arming Goophone to lose a court case.

    I look at it again, and actually they are dumb to sue. They think they can get something out of this, but they can’t. If Apple can win against Samsung phones who only look a little bit like an iPhone, this is dead. It looks way too similar to an iPhone 4. Like the iPhone 4 longer, with a little bit different back. They got the same logo placement, same metal band, same volume buttons, same home button. Sure I would like Apple to get some payback, but they aren’t. Maybe soon, but this isn’t it.

    But the iPhone 5 isn’t released yet so they could have a case. Patents stand in court. Its not what you know its what you can prove. So apple would be smart to not even release it in china.

      Apple just need to prove that their design originated from stolen trade secret and their patent will be gone in no time. This, however, does remind me of one thing — if Apple could patent some obvious designs such as a round corner rectangular shape device, why couldn’t Android makers do that. Motorola, for example, can patent a thin device with a ridiculously big battery. Samsung can patent a thin but large phone device, etc. At some points, Apple will step on the patented design and then the Android makers can sue back.

      Yea. They also have a copyright system, that’s even harder to believe. But you know what, the next day after the Beijing Olypmics Opening Ceremony, you could find pirated DVD on the street — they couldn’t even protect their state-owned content.

      Yup, and if the iPhone 5 was blocked because of this, that would be HILARIOUS. Chinese have copied cars for years and I read about how one car manufacturer (BMW?) sued the Chinese company and they LOST the lawsuit.

      Their legal team doesn’t need to be better than apple. It is a Chinese patent for a device sold only in China made by a Chinese company. That means they will win against Apple if a lawsuit makes it to court before a settlement is reached just to shut the Goophone makers up.
