He has this disclaimer in the market description:

And doesn’t ever mention Portal, Portal 2, or Valve anywhere; just uses the name Wheatley. I am not a copyright lawyer, or a lawyer at all, but he is trying very hard to get around the copyright on what he essentially copied. IMO, it looks similar to Wheatley and has the same name, that’s basically the same as what shows like South Park do to put poorly drawn and impersonated celebrities on their show to drag their names through the mud while gaining profits from advertisements and also get away with it.

Yeah I wasn’t sure if they could or couldn’t. I simply put “CAN” since I’ve had people in the past think I wrote “can’t” every so often. It’s one of those fine lines though. However charging for this, is ridiculous and Google shouldn’t have let it through.
