Samsung Wins 3G Patent Dispute in Holland, Apple May Have to Pay Up

The patent wars seem never ending at this point, but there is good news for Samsung just before the launch of their Galaxy SIII around the world. In a patent dispute in Holland over European Patent EP1188269 which is an “apparatus for encoding a transport format combination indicator for a communications system,” Apple is said to have infringed upon Samsung. There is not likely to be any kind of ban on products at this point, but Apple may have to pay to keep things from getting ugly. The two companies are working towards a compensatory deal at the moment, we’ll have to wait and see how much the case was worth.

    Why is it that apple wins a case and they ban a product. Samsung wins a case and the judge orders Samsung to seek a monetary compensation….! o_O

      It may be because Samsung’s patent could be considered “FRAND” (Fair, Reasonable, And Non-Discriminatory), meaning that Samsung’s patent is so essential to basic operation that competitors would find it extremely difficult or impossible to work around. Thus, courts push for FRAND licensing agreements to resolve the patent disputes.

      BTW, I love how when Apple loses a patent dispute, the first thing they cry from their quivering lips is, “That a FRAND patent!” But, they believe that NONE of their patents are FRAND.

    Funny how a Samsung patent is for something like an “apparatus for encoding a transport format combination indicator for a communications system,” but Apple’s are for things like “slide to unlock” or “a freaking rectangle.” Shows who the real innovators are.

      Anything can be made to sound stupid if you try hard enough.

      Nowhere in Apple’s patents does it mention “A freaking rectangle”, just as nowhere in Samsung’s patents does it mention “encoding, just like everyone else…but for communication!”

      There are no innovators anymore. It’s all a rehash of what’s been done before. Hell, Moses presented the first tablets… 😉

        Apple did use a rectangular shape Community Design patent to block the Galaxy Tab 10.1 in Germany.

          That’s a lot different than “a freaking rectangle”.

          Yeah, the Community Design registration (which is not a patent) is stupid. That wasn’t really the point though.

          Both Apple’s and Samsung’s claims are idiotic. Why make one look worse than the other? They both look equally stupid when it comes to these pissing matches.


          A Community Design Registration is inexpensive to acquire (the official filing fees start at €230($~300).) A registration can protect the appearance of the whole or part of a product resulting from its lines, contours, colours, shape and texture, and from the materials from which it is made, as well as its ornamentation.

          The kicker is that it’s supposed to be “novel” in order to be granted. I guess the EU’s CD registration folks are as messed up as our USPTO.

      Apple is going to sue Mother Nature next in the world court. Apple is claiming that they invented the Apple and that Mother Nature is infringing on their creation.

      I’ll post more on this developing story as I’m able to find more details.
