Apple’s Lawyers: Samsung’s Galaxy Nexus is a Copycat Product

When will the madness come to an end? In a new plea to the courts, separate from the case happening down in San Jose between Samsung and Apple, Apple’s lawyers are looking for an appeals court to go through with the ban on the Galaxy Nexus. Apple states that the Galaxy Nexus was purely a “copycat product” in an attempt to steal smartphone market share. As you may re-call, Apple did win a previous injunction on the device, but thankfully Google was able to fix the unified search issue that was in question. 

Apple’s game plan will be to show that the Galaxy Nexus did indeed steal some share from the iPhone and caused millions of dollars in damages, but Samsung’s lawyers believe that will be very difficult, given the Galaxy Nexus’ “miniscule” sales numbers. According to Bloomberg, a trial is set to take place March 2014. It looks like we’ll be waiting a while for all of this to end.

    Isn’t competition supposed to steal sales away from each other? Isn’t that the whole point? So because some people bought a competitors pone then they are copying and need to be banned. Apple isn’t the only company in the world despite what they may think. I really hope that so many people are disappointed with the iPhone 5 and they take a hit to sales, but I know people will buy it just because of the logo and told it’s revolutionary.

I totally would have bought their tiny, boxy, limited P.O.S. of a phone if it weren’t for a better phone, sitting un-advertised in the darkest corner of every Verizon store (10 feet away from the 8 foot Apple display.)     Sounds like they are just saying that Apple lost sales due to the software similarity case they already won. Its a clown argument, but I don’t think Apple is saying the Galaxy Nexus resembles the iPhone, or at least thats how I read this.

    I feel the main issue is that Steve Jobs always dreamed of a device that had no visible buttons, was smooth and glossy, and zen like. And what happened??? Google made them eat it. If Apple ever tries to come out with a phone like that, they will be called the copycats.

    I often wake up in a panic thinking I have an iPhone. Then the sleep clears from my eyes and I realize it’s a Galaxy Nexus. They just look so similar that it’s hard to know.

    GNex is no where near the iPhone, both looks and UI. This phone was aimed at intermediate-advanced users, whereas the iPhone is aimed at beginner’s with it’s basic features. Apple is obviously clawing for straws like a drowning rat.

    My daughter has an iPhone 4S, I have a GNex. The screens are much different sizes, the colors don’t match. If I picked up her phone by accident, I would know immediately, solely on feel, that I have the wrong phone.

    Beyond the fact that they are both smart phones, there’s almost no physical similarities between our two phones. Sorry, Apple, you bit the wrong fruit here.

      where in the article does it say what software they copied other than unified search? they don’t know what the other patents are yet their posting an article around a feature that was changed. good job!

        They didn’t copy unified search. It’s a natural and obvious evolution for search functionality. That would be like “copying” movable shelves on a refrigerator.

    I’d be interested to see their case on the Galaxy Nexus now that the only feature remotely similar, unified search, is gone. For them to qualify it as a “copycat device”, there’d have to be a lot of similarities.

    No front buttons, much larger screen, icons don’t even remotely match, app drawer, LTE, NFC..I mean..come on. This is bogus.

    the claim is on samsung’s similar design to the iPhone5 that’s coming out. Apple patented it forever ago and samsung took the designs and came out with their phone first. Apple only comes out with a new phone once per year to pace the marketing aspect and bring in the cash

            What in the article makes Apple look anything less than a big crybaby? The judge is even annoyed with them and their mudslinging. Their case is complete garbage and they’re trying to prove that somehow Samsung, with one phone, has diminished a significant portion of their market share. Android is what is killing apple now… but they’re going after Samsung because Android has a lot more power in its corner. (Like Motorolla and it’s multiple patent lawsuits that they can unleash upon Apple).

    I’ve had several i*hone owners comment on “how massive” my Nexus is compared to their toy-sized screen. Anyone who believes that the Galaxy Nexus is a copy of the i*hone is as big a schmutz as Apple.

      Some lawsuits are even pointless to even file if they take this long to go to trial. What is the point besides banning a product like they did with the already replaced Galaxy Tab 10.1 ? Samsung is like two steps ahead of Apple in that regard, not to mention better designs than that minuscule iCrap

    Maybe it’s just me but even from a design standpoint, there isn’t very many similarities between the GNex and an iphone.

        I don’t think that’s quite how it goes. I think it’s more like “Don’t even try to beat them when it’s easier to rest on your laurels and sue!” Let’s be honest, with the cash Apple has stashed away, they’re perfectly capable of doing what’s necessary to “beat ‘em,” which is why it’s even more depressing that they’d rather not and litigate instead. Innovation is good, litigation is bad.

            Their strategy is to go after the GNex because it’s stock Android. If they can get a ban on the GNex, it sets a precedent, and that opens the door to getting all Android phones banned. This really does need to be Google’s line in the sand.

          Yet that’s exactly what Apple has been winning with over seas or at least causing trouble with. It definitely holds water in court because these are patents. Instead of licensing the features Apple sues. They feel they’ll make more money suing and selling their phone’s without competition than they would off of licensing agreements like Microsoft does.

        They don’t. Apple a Microsoft signed a cross licensing deal. It’s what Google and Apple need to do but don’t hold your breath.

          Google doesn’t have enough patents to be a threat, so no cross licensing deal will occur with Google. Samsung and Apple will cross license, along with HTC, Sony and LG. Any smaller Android players will be squeezed out of the market, or driven out of business if they become a threat. Everybody except for the customer and small businesses wins.

      Why is this allowed to continue? Car makers could cripple the entire court system suing over similar components: doors, wheels, seats windows, trunks, lights, etc. What is more important is the entire system and how companies differentiate how they combine these common components to create the best user experience. Imagine all cars with different polygons for wheels because one maker thought to copyright “round” wheels.

      Arguably, Apple was at least winning that war. Let’s face it, the GNex has always appealed to the alpha geek — it wasn’t hard for Apple to blow past in that area. We’ll see how the GS3 does, but it’s likely safe to assume it’ll fare better than the GNex has.

    Apple is being stupid now. They’re using their lamest cards to pull off what they want. They have already realized that they lost the race since ’11 with the Galaxy S 2 launch. How can they accuse the Nexus being ANYTHING alike the 4S? It just blows my mind.

    Plus, they’re just scared. And they know that any Samsung device right now is infinitely better than any of their products.

            Google applied for the patent, it is still pending approval at this time. Unfortunately, unless you’re Apple, patents can take years to process.

      Yes, a phone with a huge screen, curved glass, and no physical buttons is a copycat of a phone with a tiny screen, flat glass on the front and back, and a physical button. That makes sense.

    The curved plastic, the curved edge glass screen, the on-screen navigation buttons, and the stock Android software could clearly be believed to be a 4S.
