Fate of Samsung’s Galaxy Tab 10.1 Rests in the Hands of Judge Koh

Samsung is still fighting to lift the sales ban on the Galaxy Tab 10.1 and today, the Appeals Court of theĀ Federal Circuit has placed the official decision in the hands of Judge Lucy Koh. So basically, Samsung can begin to argue that the ban should be lifted, given that it was found by a full jury that the tablet did in fact, not infringe on any design patents of Apple’s, but merely some software issues that can be amended.

As for now, who knows which way Judge Koh will lean. Time to get those arguments in, Samsung.

Evidence that you people should be blaming the jury, not the judge. Judge Koh tried to get Samsung & Apple to settle out of court & even said that the trial was a huge waste of tax dollars. She even asked apples lawyers if they were smoking crack.

So here is Judge Koh doing the right thing & lifting the sales ban on the Galaxy 10.1.

Just wait until Motorola/Google goes to town with Apple.

  • chris125

So essentially samsung is screwed because Koh is clearly getting paid off by apple.

Federal appeals gives it back kohl Wtf? Apple pockets run deep! Thats all i can say.

  • Rpatton

Apple Will fill her pockets to ban it and keep i banned just like they did in the trial it was all one sided the Corporate States Of America

    • michael arazan

Legally they can’t fill her pockets, but its ok if she owns stock in the company. A Judge can dismiss themselves if they feel they are personally bias, which rarely happens.

Based on her past performance, one sure would think she was being paid out by Apple. Not to mention the jury will all be from Appletino.

BREAKING NEWS: Judge Lucy Koh has been found dead in a car droven in a lake. Reports say she was using an iPhone 5 to navigate, but the streets lead into the lake.

  • Nicholassss

If they can’t sell them, could they just give them away. Like maaaad sweepstakes style?

  • nightscout13

Koh will be late to the hearing, cause iOS 6 Maps will get her lost!

This is complete and utter BS.

Not like it’s on shelves here anyways…

  • EvanTheGamer

If that’s the case, the Galaxy Tab 10.1 is pretty much toast.

I think the Judge is fair. It was the jury that got a little crazy with 1.05B awarded.

    • LAmDroid

it was far from fair. there were quite a bit behind the scenes that were manipulated to design the trial in Apple’s favor. The Jury being quite the example, there’s a reason why it was such a crazy jury. It was a head scratcher why Samsung’s lawyers allowed a patent holder to be a juror. I’ll just say someone Im related to on the Samsung side of things later told me about the Jury selection.

I cant believe Koh is still overseeing this whole thing.

      • MicroNix

Yeah, why would an appeal go to the same judge that screwed you the last time? At the very least, this trial should be anywhere BUT California.

      • brkshr

        Told you guys! :-)

The Judge tried to get them to settle out of court last time & even said herself that the trial was a joke. Just because the jurors screwed the pooch, doesn’t mean the Judge was not fair. The jurors were idiots, not the judge.
