Motorola Sues Apple for Patent Infringement

The battle of Android and the i*hone just got more intense today when Motorola filed three complaints against Apple for 18 patent infringements.  The complaints attack Apple’s entire lineup of devices including the i*hone, i*ad and even some of their computers.  Most of the patents relate to wireless communications technologies such as antenna design, proximity sensing and location-based services…

…Motorola Mobility, Inc., has filed a complaint with the U.S. International Trade Commission (ITC) alleging that Apple’s iPhone, iPad, iTouch and certain Mac computers infringe Motorola patents. Motorola Mobility also filed patent infringement complaints against Apple (NASDAQ: AAPL) in the Northern District of Illinois and the Southern District of Florida.

Overall, Motorola Mobility’s three complaints include 18 patents, which relate to early-stage innovations developed by Motorola in key technology areas found on many of Apple’s core products and associated services, including MobileMe and the App Store. The Motorola patents include wireless communication technologies, such as WCDMA (3G), GPRS, 802.11 and antenna design, and key smartphone technologies including wireless email, proximity sensing, software application management, location-based services and multi-device synchronization…

Motorola Mobility Sues Apple for Patent Infringement

LIBERTYVILLE, Ill. – Oct. 6, 2010 – Motorola, Inc. (NYSE: MOT) today announced that its subsidiary, Motorola Mobility, Inc., has filed a complaint with the U.S. International Trade Commission (ITC) alleging that Apple’s iPhone, iPad, iTouch and certain Mac computers infringe Motorola patents. Motorola Mobility also filed patent infringement complaints against Apple (NASDAQ: AAPL) in the Northern District of Illinois and the Southern District of Florida.

Overall, Motorola Mobility’s three complaints include 18 patents, which relate to early-stage innovations developed by Motorola in key technology areas found on many of Apple’s core products and associated services, including MobileMe and the App Store. The Motorola patents include wireless communication technologies, such as WCDMA (3G), GPRS, 802.11 and antenna design, and key smartphone technologies including wireless email, proximity sensing, software application management, location-based services and multi-device synchronization.

Motorola Mobility has requested that the ITC commence an investigation into Apple’s use of Motorola’s patents and, among other things, issue an Exclusion Order barring Apple’s importation of infringing products, prohibiting further sales of infringing products that have already been imported, and halting the marketing, advertising, demonstration and warehousing of inventory for distribution and use of such imported products in the United States. In the District Court actions, Motorola Mobility has requested that Apple cease using Motorola’s patented technology and provide compensation for Apple’s past infringement.

Kirk Dailey, corporate vice president of intellectual property at Motorola Mobility, said, “Motorola has innovated and patented throughout every cycle of the telecommunications industry evolution, from Motorola’s invention of the cell phone to its development of premier smartphone products. We have extensively licensed our industry-leading intellectual property portfolio, consisting of tens of thousands of patents in the U.S. and worldwide. After Apple’s late entry into the telecommunications market, we engaged in lengthy negotiations, but Apple has refused to take a license. We had no choice but to file these complaints to halt Apple’s continued infringement. Motorola will continue to take all necessary steps to protect its R&D and intellectual property, which are critical to the company’s business.”

    Isnt this essentially the same lawsuit that MS has filled against Moto? What is REALLY happening here? These companies are smart enough to know that these things that they are suing for are too broad to actually win. So what are they up to? Publicity? Trying to make the other look bad? I also agree with the comments that Moto should NOT be telling people that Apple stole their antenna designs. The would be like Mercedes suing Ford for the 70s Pinto gas tank design. Even if they did steal it, let everybody think it was theirs. Who cares?

      Haha, I agree. I remember waiting forever for my moto droid to get 2.1 after numerous promises. And It took awhile to get 2.2 for my droid x. They need to pick a release date and sick with it! Enough said.

    As far as these lawsuits go it is pretty much business as usual and the only effect is money changing hands between the companies. If any infringement is found the offender will just pay past due royalties and go into a licensing agreement to keep using the technology if it is entirely needed. No biggie, the I*hone and the I*ad will still remain the same and come out the same. These lawsuits are terrifying to small startups…not to big established companies that it is just part of doing business

    For once I just wish there was a company that cared more about the advancement of technology than suing other companies over petty things so they can make even MORE money, probably to spend on private jets and $100,000 cars, and multiple vacation homes.

        I didn't say not care about making money, I said not care about making even MORE money than they can possibly need. Considering the amount they're already making, they're pretty much well enough funded to pay for research of the latest technology for the next few decades. At this point they're just trying to get revenge on Apple. It's like a bunch of selfish children fighting, really.

          Who are you to say that a company is making more than they could possibly need? If you were making $25 an hour, and taking risks and stuff, is it fair for me to sit on my couch and say you only need $20 an hour because so and so only makes that much? Of course they’re trying to get revenge on Apple, and the way Apple treats the world, I fully support it.

          Anyway, its the objective of every company to make as much money as they possibly can. I’m all for that. Now, the way to get my money is to make the best possible product.

          In reply to the other two, who replied to me, I just don't see it. I have a Droid Incredible, and a first gen iPod Touch (I didn't get the iPhone due to it being on AT&T, terrible network). Before I got my DI, I loved the iPod Touch. It and the iPhone were unique and well designed. I'll admit that it has nothing on the Droid line of phones, but I still have to give credit where credit is due. Where would Android be if Apple hadn't set the bar? I don't see the iProducts as a curse word, but more like a good idea that opened the door to others and fell short in the end.

            It's just funny. I don't think it's for any other reason to get a laugh, and it always makes me grin. Everyone has their favorite product line, and on this site, it's clearly Android. :) The iPhone is a great product, though I think Apple is more than slightly evil. But hey, I'm typing on my MacBook Pro, and every day I want a Mac Mini server. That doesn't stop me from laughing when I see i*ad or i*hone.

        LOL sorry can’t help there. I work on the solutions side…which basically means radios and infrastructure equipment. Besides our company is splitting up away from mobility side.
